WHAT HAPPENS TO THCA FLOWER AFTER THE FEDERAL HEMP CHANGE?

After December 11, 2026, federal law measures hemp by total THC, and THCA counts toward the 0.3% limit. The rule comes from Section 781 of Public Law 119-37, which became law on November 12, 2025 with a start date one year out.

A stopgap passed as H.R. 6500, now Public Law 119-103, narrowed that start on September 2, 2026: until December 11, Section 781 reaches only products made with cannabinoids the hemp plant doesn't make on its own. From then on, flower with a total tetrahydrocannabinols concentration, including THCA, above 0.3% on a dry weight basis would fall outside the federal hemp definition.
