WHY IS THCA BEING BANNED?
Section 781 of Public Law 119-37, signed November 12, 2025, rewrote how federal law defines hemp. The new definition measures hemp by total THC, including THCA, at 0.3% or less on a dry weight basis, and leaves out finished products with more than 0.4 milligrams of total THC per container, according to the Congressional Research Service.
Because THCA counts toward that limit, most THCA flower would no longer qualify as hemp once the new definition applies.
Section 2019 of Public Law 119-103, signed September 2, 2026, limits the changes until December 11, 2026 to products with cannabinoids the plant can't produce naturally. The rest of the new definition, including the total THC measure, applies from December 11. State laws vary, and none of this is legal advice.
